The Federal Court of Justice dismissed the defendant's revision as unfounded, affirming the conviction of the Higher Regional Court of Marburg, while applying a procedural modification that counts an additional two months of total detention as served due to the overall duration of the proceedings; the defendant was ordered to bear the costs of the appeal and the necessary expenses incurred by the civil party. The dispute centered on a criminal appeal challenging the lower court's judgment, which had found no legal errors to the detriment of the accused upon re-examination based on the revision's justification. The decision rests on the standard of review for criminal appeals, specifically the determination that no reversible legal error was identified, coupled with statutory provisions governing the crediting of time served in extended proceedings.
