The Federal Court of Justice dismissed the tenant's (defendant's) revision as inadmissible regarding the formal validity of the rent increase declaration from December 15, 2016, and otherwise rejected it on the merits, thereby upholding the lower court's judgment in favor of the landlord (plaintiff) and ordering the tenant to bear the litigation costs. The dispute concerned a modernization rent increase where the tenant challenged the formal requirements and the calculation basis of the landlord's subsequent increase declaration, specifically arguing that it must be based on actually incurred costs rather than the initial cost estimates cited in the prior announcement. The Court held that while the revision was procedurally inadmissible for lack of leave to appeal on the specific issue of formal validity, the substantive arguments failed because the reference in the final increase declaration to the original announcement sufficiently satisfied the requirement to inform the tenant that no lower costs were incurred for the performed works, and the tenant's right to verify the plausibility of the costs is fully protected by the comprehensive right to information and inspection under § 259 BGB, rendering the landlord's declaration legally sufficient. Key legal provisions applied include §§ 542, 543, 552, and 552a ZPO regarding procedural admissibility and rejection, and § 259 BGB (applied by analogy) regarding the tenant's inspection rights.

§ 552 Abs. 1 ZPO

Cited as the main ground for declaring the revision inadmissible regarding the issue of formal validity due to lack of permission to appeal.

§ 552a Satz 1 ZPO

Cited as the main ground for rejecting the remaining revision because the conditions for admissibility were not met and there was no prospect of success.

§ 542 Abs. 1, § 543 Abs. 1 Nr. 1 ZPO

Cited to support the procedural finding that the revision was not permissible due to the lack of leave to appeal by the lower court.

Juli 2022 - VIII ZR 361/21, NJW-RR 2022, 1455 Rn. 46 ff. mwN).
