Inadmissibility of Correction and Hearing Complaint Applications for Lack of Authorized Counsel; Effect of Mandate Termination on Judicial Service
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed as inadmissible the plaintiff's applications for correction of a prior senate order and for a hearing complaint, placing the costs on the plaintiff. The dispute arose from the plaintiff's objection to a procedural ruling regarding the termination of his power of attorney and the service of a previous order, which he argued violated his right to be heard. The court held both applications inadmissible because they were not filed by a lawyer authorized to practice before the Federal Court of Justice, as required by Section 78 Paragraph 1 Sentence 3 of the Code of Civil Procedure. The court further noted that the applications would have been unfounded on the merits, as the termination of a mandate only becomes legally effective vis-à-vis the court upon notification of the appointment of a new counsel under Section 87 Paragraph 1 Half-sentence 2 ZPO, meaning the earlier service of the order was valid.

BGH, Beschluss vom 25. Januar 2022 - VIII ZR 233/20, NJW-RR 2022, 709 Rn. 28).
