The BGH XI Civil Senate rejected the plaintiff's application for a stay of proceedings and dismissed his complaint against the non-acceptance of revision by the Munich Higher Regional Court, leaving the lower court's judgment in force. The dispute centered on the plaintiff's attempt to have the BGH accept revision on grounds of fundamental legal significance, legal development, or uniform jurisprudence, but the court found these criteria unmet and affirmatively assessed the prospects of a potential revision as negative. Relying on established case law and citing specific prior decisions from May and June 2020, the court applied § 543(2) Sentence 1 ZPO to deny the complaint and § 544(6) Sentence 2 ZPO to waive a further detailed written reasoning, ordering the plaintiff to bear the costs of the complaint proceedings with a subject matter value capped at €50,000.

Juni 2020 (XI ZR 132/19, juris). Von einer weiteren Begründung wird gemäß § 544 Abs. 6 Satz 2 Halbs. 2 ZPO abgesehen.

Der Kläger trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).

Der Gegenstandswert des Beschwerdeverfahrens beträgt bis zu 50.000,00 €.
