Admission of civil revision appeal in construction law dispute: lack of fundamental significance and uniformity of jurisprudence requirements
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's non-admission complaint against the Munich Higher Regional Court's decision of July 12, 2019, ordering the plaintiff to bear the costs of the proceedings. The dispute concerned a civil matter where the plaintiff attempted to challenge the lower court's refusal to admit a revision appeal. The court held that the legal issues lacked fundamental significance, and that neither the development of law nor the assurance of uniform jurisprudence required a decision by the revision court under § 543 Abs. 2 Satz 1 ZPO. Consequently, the appellate court's decision remains in force, with the BGH relying on prior consistent rulings to decline further elaboration and adhering to the standard that a complaint fails if a revision would not be successful.
