Legislator-Zusammenfassung

The Federal Court of Justice (BGH) 6th Criminal Senate dismissed the defendant's revision as unfounded, upholding the Landgericht Ansbach's conviction and ordering the defendant to bear the costs of the appellate proceedings. The dispute concerned the sentencing classification of Gamma-Hydroxybutyric acid (GHB) under German drug laws, specifically whether the quantity involved constituted a "non-minor amount." The court confirmed that the lower instance correctly applied a threshold of 200 grams of Sodium-gamma-Hydroxy-Butyrate to define a non-minor quantity of GHB, relying on the expert-consulted precedent of the Landgericht Berlin and the Kammergericht Berlin. This ruling validates the specific quantitative limit for GHB trafficking offenses without reversing the underlying criminal judgment.

Betäubungsdelikt: Bestimmung des Grenzwerts einer nicht geringen Menge GHB

[TENOR]
