Joinder of revision proceedings for simultaneous hearing of comparative suicide facilitation and rescue omission charges under § 237 StPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice ordered the joinder of two separate revision proceedings into a single simultaneous main hearing pursuant to § 237 of the Code of Criminal Procedure. The dispute concerns appeals filed by two different state prosecution authorities against acquittals issued by the Hamburg and Berlin Regional Courts, in which defendants were found not guilty of charges involving the facilitation of suicides and the omission of rescue measures for unconscious suicide victims. The court based the joinder on the presence of partially comparable factual circumstances and partially identical legal questions across both cases, aiming to ensure a coordinated adjudication of these distinct criminal revisions.
