Judicial recusal proceedings: Inadmissibility of legal appeal without court admission and denial of court-appointed counsel
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the debtor's legal appeal (Rechtsbeschwerde) as inadmissible, rejecting the accompanying request for a court-appointed attorney and ordering the debtor to bear the legal costs. This decision arose from a debtor's challenge to a Lower Regional Court's (Landgericht) ruling within a judicial recusal procedure, where the Lower Regional Court had previously declined to admit the legal appeal. The court held that in proceedings concerning the rejection of a judge, an appeal to the Federal Court of Justice is not statutorily permissible unless explicitly admitted by the appellate court, which did not occur here; consequently, the non-admission of the appeal is not subject to judicial review and no extraordinary or constitutional remedy is available. Because the appeal was fundamentally inadmissible, the pursuit of legal redress was deemed devoid of prospects of success, barring the appointment of a court-appointed counsel. The ruling relied on §§ 574, 577, and 78b of the Code of Civil Procedure (ZPO) to establish the procedural bars against the appeal and the futility of the motion for legal aid.

Die Rechtsbeschwerde gegen den Beschluss des Landgerichts Augsburg - 4. Zivilkammer - vom 1.
BGH, Beschluss vom 18. Januar 2018 - I ZB 101/17, juris Rn. 4 mwN). BGH, Beschluss vom 9. Dezember 2021 - I ZB 57/21, juris Rn. 2 mwN). BGH, Beschluss vom 22. Juni 2021 - I ZB 28/21, juris Rn. 2 mwN).
II.
III. Die Kostenentscheidung beruht auf § 97 Abs. 1 ZPO.
