Benefit offsetting of resale proceeds and usage advantages in consumer sales rescission
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff’s complaint against the non-admission of revision, upholding the appellate court’s judgment from the 30th Civil Senate of the Munich Higher Regional Court in Augsburg. The dispute centered on consumer protection and unjust enrichment, specifically challenging the appellate court’s application of advantage offsetting (Vorteilsausgleichung), where it credited both usage advantages and the proceeds from the resale of a purchased good against the claim. Relying on established principles from prior BGH decisions (May 2020 and July 2021) and interpreting the Court of Justice of the European Union’s ruling to prevent unjustified enrichment of claimants, the court found no need for revision as the matter lacked fundamental legal significance or a need to ensure uniform case law; consequently, the plaintiff bears the costs of the complaint proceedings, with a dispute value capped at €35,000.
