Criminal revision: scope of review under § 349 Abs. 2 StPO and denial of compensation for procedural delay
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) fourth criminal senate rejected the defendant's appeal as unfounded, upholding the Landgericht Münster's judgment of 16 May 2022, and ordered the appellant to bear the costs of the proceedings and the necessary expenses of the auxiliary claimant. The dispute involved a criminal revision challenging the lower court's conviction, with no legal error to the detriment of the defendant identified upon review under § 349 Abs. 2 StPO. The court additionally noted that the duration of the appellate proceedings was appropriate, denying a request for a compensatory decision based on a minor procedural delay caused by the re-service of the judgment on the auxiliary claimant's representative.

Volltext
