Non-admission of revision for lack of fundamental legal significance or uniform jurisprudence in civil dispute
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) 5th Civil Senate dismissed the plaintiff's complaint against the non-admission of revision, leaving the Landgericht Braunschweig judgment of September 9, 2022, in force. In a civil dispute involving a claim amount of 56,938.77 EUR, the plaintiff argued that the case required a higher-level review, but the BGH determined that the matter did not raise questions of fundamental legal significance and was not necessary for the development of the law or the assurance of uniform jurisprudence. The decision was based on § 543(2) of the Code of Civil Procedure (ZPO), which sets the strict criteria for admitting a revision, and § 97(1) ZPO, which assigned the costs of the complaint proceedings to the plaintiff. The court further clarified that the filing of a non-admission complaint does not trigger an ex officio adjustment of the dispute value for previous instances under § 63(3) GKG.
