The Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-acceptance of the appeal, leaving the appellate court's judgment in favor of the defendant in force. The dispute concerned a claim for damages under tort law, specifically alleging a breach of product liability or food safety regulations (referencing § 6 Abs. 1, § 27 Abs. 1 EG-FGV or Art. 5 Regulation (EG) No. 715/2007 in conjunction with § 823 Abs. 2 BGB), where the plaintiff challenged the lower court’s refusal to admit a revision appeal. The BGH held that the case lacked fundamental significance and that no development of law or unification of jurisprudence was required, as the appellate court had correctly found that the essential element of a culpable unlawful act was missing; consequently, the plaintiff was ordered to bear the costs of the complaint proceedings, with the subject matter value set at up to 50,000 €.

§ 543 Abs. 2 Satz 1 ZPO

Ground for dismissing the non-acceptance complaint because the legal matter did not have fundamental significance or require further development of the law.

§ 544 Abs. 6 Satz 2 Halbsatz 2 ZPO

Procedural basis allowing the court to omit a detailed explanation as it would not contribute to clarifying the prerequisites for admitting a revision.

§ 97 Abs. 1 ZPO

Basis for ordering the plaintiff to bear the costs of the complaint proceedings.
