Offsetting usage advantages in civil liability: application of BGH case law and EU unjust enrichment principles in admission of revision
Legislator-Zusammenfassung
KI-generiertThe Bundesgerichtshof (BGH) dismissed the plaintiff’s complaint against the non-admission of revision, thereby upholding the appellate judgment and leaving the plaintiff to bear the costs of the proceedings. The dispute, valued at up to €35,000, concerned a civil liability case where the plaintiff challenged the lower court’s refusal to admit an appeal to the BGH, specifically objecting to the appellate court’s application of the doctrine of *Vorteilsausgleichung* (advantage offsetting) to credit certain usage advantages against the claim. The BGH held that the appeal lacked fundamental significance or a need for the development of law, citing its own 2020 precedent that had already clarified the relevant principles for advantage offsetting and finding that a recent 2023 Court of Justice of the European Union ruling on preventing unjustified enrichment did not alter this domestic legal framework; the court also deemed alleged violations of fundamental procedural rights to be unfounded.
