The Federal Court of Justice dismissed the debtor's motion for hearing complaint (Anhörungsrüge) as inadmissible and unfounded, upholding the prior court order and leaving the debtor to bear the costs. The dispute concerned a procedural objection to a non-appealable district court decision in an insolvency-related proceeding, where the debtor argued that their right to be heard was violated. The court ruled that the complaint was procedurally defective for not being filed by a lawyer admitted to the Federal Court of Justice and substantively unfounded, holding that no appellate remedy existed against the lower court's order and the debtor could not expect a substantive response to further submissions; the decision rests on the requirements of § 78(1) sentence 3 ZPO and § 321a ZPO.

Volltext
