Refusal of revision admission for lack of fundamental legal significance in real property dispute
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, rejecting the claim that the case involved questions of fundamental significance or required further development of the law, thereby upholding the appellate court's judgment and ordering the plaintiff to bear the costs of the proceedings. The dispute arose from a civil matter where the plaintiff challenged the higher regional court's refusal to admit revision to the BGH, a procedural step necessary to review the merits of the underlying case. The decision was grounded in § 543(2) of the Code of Civil Procedure (ZPO), which sets the strict requirements for admitting revision based on fundamental legal questions or the need for uniform case law, and the court further noted that it lacked the authority to modify the subject matter value fixed by the lower instances under § 63(3)(1)(2) of the Court Costs Act (GKG) in connection with the appeal procedure.
