Non-admission of revision where appellate decision rests on independent lack of damages and alleged EU law issues are not substantiated
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the decision of the Oberlandesgericht Naumburg and leaving it in force; the plaintiff bears the costs of the proceedings. The dispute concerned a civil matter where the appellate court had independently grounded its judgment on the absence of damages suffered by the plaintiff, and the plaintiff argued that the case had fundamental legal significance or required the development of law, including references to EU law, but failed to substantiate a valid ground for admission under § 543 Abs. 2 ZPO. The BGH found no procedural fundamental rights violations and relied on § 544 Abs. 6 Satz 2 ZPO to refrain from a detailed written justification, as such an explanation would not contribute to clarifying the prerequisites for admitting revision.
