Legislator-Zusammenfassung

The Federal Court of Justice dismissed the plaintiff's non-admission complaint, rejecting the appeal against the appellate court's decision and leaving the lower court's ruling in force, with the plaintiff bearing the costs of the proceedings. The dispute concerned a tort claim for damages, where the plaintiff alleged liability under § 823 Abs. 2 BGB in conjunction with food safety regulations, specifically § 6 Abs. 1 or § 27 Abs. 1 of the Food and Feed Law Enforcement Act (EG-FGV) or Article 5 of Regulation (EC) No. 715/2007. The Court determined that the appellate court's decision was independently grounded on the finding that the defendant had not committed a tortious act through fault, and that the plaintiff failed to demonstrate grounds for admission such as fundamental legal significance, the development of law, or the need for uniform legal practice. Consequently, no further substantive review was conducted, and the claim for damages was denied.

Volltext
