Legislator-Zusammenfassung

The Federal Court of Justice (Service Matters) dismissed the defendant's exclusion motions against all five panel members as inadmissible and rejected the defendant's complaint of denial of hearing as both procedurally deficient and substantively unfounded, leaving the prior panel decision of January 10, 2023, in full effect. The case involved a public servant (defendant) challenging the composition of the adjudicating senate and alleging that the earlier ruling violated their right to be heard by failing to address their submissions. The court held that the exclusion motions were manifestly inadmissible under constitutional standards for judicial recusal, and the complaint failed because it did not adequately demonstrate a violation of the statutory right to a hearing; furthermore, the court noted that the previous panel had fully considered the defendant's arguments without issuing a surprise decision, rendering the objection moot on the merits. Key legal bases included § 63 DRiG, § 3 BDG, and §§ 152a, 152b VwGO regarding the standards for challenging judicial independence and the requirements for demonstrating a denial of hearing.

Die Ablehnungsgesuche der Beklagten mit Schriftsätzen vom 3. Februar 2023, 10. Februar 2023, 24. Februar 2023, 24.
