Liability of convicted defendant for auxiliary plaintiff’s counsel fees despite lack of valid intervention declaration
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant’s appeal on the merits and upheld the lower court’s judgment, while correcting the cost allocation by ordering the convicted defendant to bear both the procedural costs and the necessary expenses incurred by the victim’s legal representative. The dispute concerned a criminal case where, despite the lack of a valid declaration of intervention by the injured party, the trial court had appointed a lawyer for the person entitled to participate as an auxiliary plaintiff. The court ruled that under § 472(3) sentence 1 in conjunction with §§ 406h and 397a(1) StPO, a convicted defendant is liable for the necessary expenses arising from the exercise of powers by a court-appointed auxiliary plaintiff's representative, even if the formal conditions for auxiliary plaintiff status were not fully met.

Kostenentscheidung in einer Strafsache: Notwendige Auslagen des Nebenklageberechtigten
[TENOR]
BGH, Beschluss vom 8. Oktober 2008 – 1 StR 497/08, NStZ 2009, 287; BeckOK StPO/Weiner, 46. Ed., § 472 Rn. 13).
