Aggravated robbery sentencing: irrelevance of defective blood alcohol concentration calculation for diminished criminal capacity
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the defendant's appeal as unfounded, upholding the lower court's conviction for aggravated robbery and the resulting prison sentence of three years and six months. The defendant challenged the sentencing on grounds of a material legal error, specifically arguing that the lower court's calculation of blood alcohol concentration (BAC) was defective due to the missing data on the defendant's body weight, which allegedly necessitated a finding of significantly diminished criminal capacity. The appellate court held that despite the technical flaw in the BAC calculation, it was impossible that correct findings would have led to a conclusion of significantly diminished steering capacity, given the documented consumption volume and performance behavior; consequently, the court ordered the defendant to bear the costs of the appeal.
