The Federal Court of Justice (BGH) rejected the plaintiff's application for the recusal of the presiding judge, ruling the motion inadmissible as unfounded and thereby upholding the continuity of the judicial panel. The dispute arose in a legal complaint (Rechtsbeschwerde) where the plaintiff alleged bias because the court allegedly ignored arguments and motions contained in a procedural document, failing to account for the mandatory representation requirements in appellate proceedings. The court held that no grounds for mistrust of the judge's impartiality under § 42 Abs. 2 ZPO existed, as the legal complaint was filed without a lawyer admitted to the BGH; since statutory attorney representation is mandatory under § 78 Abs. 1 ZPO and the complaint was not admissible in the first place (rendering a court-appointed lawyer under § 78b Abs. 1 ZPO unnecessary), the unrepresented filings were ineffective. The court further determined that obtaining a personal statement from the recused judge under § 44 Abs. 3 ZPO was unnecessary as it would not contribute to clarifying the relevant facts.

Januar 2016 - I ZB 95/15, juris Rn. 1; vom 27. Mai 2020 - I ZB 5/20, juris Rn. 4). Mai 2020 - I ZB 5/20, juris Rn. 4; vom 4. Februar 1992 - X ZB 18/91, NJW 1992, 1700, juris Rn. 6).

Senatsbeschluss vom 10. Februar 2021 - VI ZB 66/20, VI ZB 67/20, juris Rn. 7 mwN).
