The Federal Court of Justice dismissed the debtor's legal complaint (Rechtsbeschwerde) as inadmissible, thereby upholding the lower regional court's decision in the insolvency proceedings. The dispute involved the debtor's attempt to challenge a regional court order regarding insolvency matters, which she labeled as a "further complaint" but which the court classified as a legal complaint given her intent to have the supreme court reverse the lower decision. The court held that the appeal was statutorily inadmissible because, following the repeal of the provision allowing general appeals in insolvency cases, such appeals are only permissible if expressly admitted by the regional court, which had not done so in this instance. Additionally, the court noted a procedural defect, as the appeal was not filed by a lawyer authorized to practice before the Federal Court of Justice. The decision relied on §§ 574, 575, 577 ZPO, emphasizing that the absence of appellate admission and non-compliance with the mandatory representation requirement rendered the legal complaint unassailable.
