Assessment of professional disability when preparing a transition from salaried to self-employed activity
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's revision without a hearing, rejecting it as inadmissible and lacking prospects of success, thereby upholding the appellate court's judgment and leaving the costs to the plaintiff. The dispute concerned a disability insurance claim within an occupational pension scheme, specifically challenging the assessment of professional disability when the insured individual was preparing to transition from a salaried role to a self-employed hobby activity. The decisive legal issue was the interpretation of the term "profession" under German insurance law in cases where an insured person simultaneously maintains their former employment while preparing for a new line of work; the court held that this question is not capable of a generalized legal clarification and must be resolved solely based on the specific circumstances of the individual case, finding no reviewable error in the lower court's factual assessment.

[TENOR]
