Status of EU Gas Regulation Provisions as Protective Laws under § 823 Abs. 2 BGB
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, rejecting the request for a stay of proceedings and ordering the plaintiff to bear the costs of the appellate procedure. The dispute concerned a civil claim where the plaintiff argued that specific provisions of the German Federal Act on Energy Efficiency and the EU Regulation No. 715/2007 constitute protective laws under § 823 Abs. 2 BGB, but the court determined that this legal question was not decisive for the outcome, relying on prior case law. The court held that the case lacked fundamental legal significance, necessitated no legal development, and did not require a decision to ensure uniform jurisprudence under § 543 Abs. 2 ZPO, thereby affirming the lower court's refusal to admit the revision.

BGH, Urteil vom 22. Februar 2022 - VI ZR 265/20, VersR 2023, 341 Rn. 18; Urteil vom 22. Februar 2022 - VI ZR 934/20, VersR 2022, 852 Rn. 14; Beschluss vom 12. September 2022 - VIa ZR 230/22, juris Rn. 17).
