The Federal Court of Justice (BGH) granted the defendant's application for reinstatement to his former status, ordering that the deadline for filing an appeal on points of law be restarted, with the defendant bearing the costs of the reinstatement proceeding. This procedural decision addressed the defendant's failure to file a revision against a complete judgment rendered by the Itzehoe Regional Court, where the court found that the defendant's counsel had demonstrated and made credible within the statutory period that the defendant was not at fault for missing the deadline, and had simultaneously and formally performed the missed act of filing the appeal. The ruling relies on §§ 45 and 46 of the Code of Criminal Procedure (StPO), specifically requiring a showing of no fault to warrant reinstatement, while also confirming that because the lower court had issued a full judgment with valid service, no return of the file for amendment or re-service was necessary, and the revision justification period begins upon service of this order.

Volltext

BGH, Beschluss vom 8. Februar 2023 – 2 StR 460/22 mwN).
