The German Federal Court of Justice (4th Criminal Senate) dismissed the appeals filed by two defendants against the judgment of the Landgericht Bochum, finding no legal error to their detriment, thereby upholding the lower court's conviction and sentencing. Although the defendants had to bear the necessary incidental costs for the civil parties, the court waived the imposition of the defendants' own appellate costs and expenses under juvenile justice provisions. The appellate proceedings involved challenges to the rejection of a motion to exclude public access to the trial and the trial court's handling of a judicial hint regarding charges; the court held that decisions under § 171b GVG in conjunction with § 336 StPO are unchallengeable and thus precluded appellate review of the public access ruling, while the trial court’s response to the § 265 Abs. 4 StPO hint remained within the bounds of its discretion.

Volltext
