Alleged illegal shut-off device in motor vehicle: sufficiency of appellate findings and admissibility of EU preliminary ruling
Legislator-Zusammenfassung
KI-generiertThe Bundesgerichtshof (BGH) dismissed the plaintiff’s complaint against the non-admission of appeal and rejected his application for a stay of proceedings, leaving the lower court’s judgment in force and ordering the plaintiff to bear the litigation costs. The dispute involved a consumer’s claim against a car dealer regarding the installation of an alleged illegal shut-off device in a purchased vehicle, where the plaintiff sought to suspend proceedings pending a preliminary ruling from the Court of Justice of the European Union. The BGH held that the appellate court had sufficiently relied on its own independent assessment of the lack of concrete evidence for the device’s installation, a factual matter not amenable to EU preliminary review, and that the plaintiff failed to demonstrate a case of fundamental legal significance, the need for legal development, or the requirement for uniform jurisprudence to justify a revision appeal under § 543(2) ZPO.
