Non-acceptance of revision in tort claim: applicability of national limitation periods to EU-derived protective laws under § 823 Abs. 2 BGB
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (6th Civil Senate) dismissed the plaintiff's complaint against the non-acceptance of leave to appeal, thereby upholding the appellate court’s judgment and leaving the lower court’s dismissal of the claim in force. The dispute concerned a civil liability action under § 823(2) German Civil Code combined with EU-derived protective laws, where the appellate court had rejected the claim primarily on the grounds that it was time-barred. The court held that the legal questions raised lacked fundamental significance and did not require further judicial clarification, noting that the Federal Court of Justice had already ruled on similar issues prior to the appellate decision, and that EU principles of equivalence and effectiveness did not preclude the application of national limitation rules. Consequently, the plaintiff bears the costs of the complaint proceedings, and the subject value of the proceedings is set at up to €30,000.

Januar 2019 - VIII ZR 18/18, juris Rn. 3; Beschluss vom 16. Dezember 2021 - I ZR 186/20, juris Rn. 27).
