BGH denies review of non-admission ruling due to lack of fundamental legal significance
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, leaving the decision of the Higher Regional Court of Celle effective and ordering the plaintiff to bear the costs of the proceedings. The dispute concerned a civil matter where the plaintiff attempted to challenge the appellate court's refusal to grant revision based on alleged defects in the lower court's reasoning. The court determined that the case did not possess fundamental legal significance, nor did the further development of law or the assurance of uniform jurisprudence require a decision by the Supreme Court, thereby applying the statutory grounds for non-admission under § 543(2) sentence 1 and § 544(6) sentence 2 ZPO.
