Admissibility of Anhörungsrüge in Rechtsbeschwerde: Mandatory representation by a BGH-authorized attorney under § 78 Abs. 1 Satz 3 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the applicant’s hearing complaint (Anhörungsrüge) as inadmissible at her expense, confirming the underlying Senate order of January 12, 2023. The dispute concerned a procedural challenge in an objection appeal (Rechtsbeschwerde) where the applicant submitted a hearing complaint arguing that her right to be heard had been violated. The court held that the complaint was procedurally defective because it was not filed by an attorney authorized to practice before the Federal Court of Justice. The decision relied on the mandatory representation requirement for objection appeal proceedings under § 78 para. 1 sentence 3 of the Code of Civil Procedure (ZPO), which applies equally to hearing complaints in that specific procedural stage, and costs were awarded to the respondent under § 97 para. 1 ZPO by analogy.
