Health insurance contribution fraud: damage attribution to aider versus principal offenders in statutorily concurring offenses
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) Fifth Criminal Senate dismissed the appeals of the defendants against the Hamburg Regional Court’s verdict of September 28, 2021, thereby upholding the original convictions and sentences and ordering each appellant to bear the costs of their legal remedy. The dispute concerned a multi-incident fraud scheme involving 23 cases of statutory concurrence, where the defendants challenged the trial court’s calculation of damage contributions, specifically alleging that the damage attributed to the aiding defendant (U.) in three specific cases (11–13) was erroneously assessed higher than the damage attributed to the principal offenders. The court ruled that the appeal was unfounded, holding that while the disparity in damage calculations between the aider and principals in the three cited instances was legally questionable, the trial court had correctly treated the entire conduct as a single act with 23 concursus units, and the negligible difference in total damage did not warrant a lower sentence.
