The German Federal Court of Justice (BGH) rejected the plaintiff's complaint against the non-admission of revision, thereby upholding the appellate court's judgment and leaving the lower court's decision in force. The dispute concerned the classification of the defendant as a "Hintermann" (third-party beneficiary or hidden party) in a civil procedure, where the plaintiff argued that the appellate court failed to adequately weigh specific circumstances and ignored previous case law from another senate of the same court. Relying on § 543 Abs. 2 Satz 1 ZPO, the BGH held that the case did not possess fundamental significance and that no legal development or uniformity in jurisprudence was required, finding that the appellate court’s assessment of the facts was not arbitrary despite the conflicting prior decision. The plaintiff was ordered to bear the costs of the complaint proceedings, with the object value set at €438,765.

Volltext
