Sprungrevision: Missing substantive demonstration of grounds for admission
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff's application for leave to file a "jump revision" (Sprungrevision) against a decision of the 11th Chamber for Commercial Matters of the Düsseldorf Regional Court, upholding the lower court's judgment and awarding the costs of the admission procedure to be shared equally between the plaintiffs. The dispute involved a commercial matter where the plaintiffs, with the defendant's written consent to bypass the appellate instance, sought direct review at the BGH but failed to substantively demonstrate any statutory ground for admission. The court held the application inadmissible because the plaintiffs did not adequately argue, as required by §§ 566, 544, and 543 ZPO, that the legal question possessed fundamental significance, that the development of law or the assurance of uniform jurisprudence necessitated a decision by the revision court.

August 2012 - I ZR 199/11, juris Rn. 4 f. mwN). 2 ZPO abgesehen.
