The Federal Court of Justice (BGH) dismissed the applicant's request for legal aid, thereby denying funding for the intended appeal, which meant the decision of the prior instance remained in force. The dispute concerned an application for legal aid to file a legal complaint against a decision of an appellate civil senate in a case governed by the Act on Financial and Probate Court Procedure (FamFG). The court held that the intended legal action lacked sufficient prospects of success and, crucially, was inadmissible because a legal complaint against such a decision is not statutorily permitted under the procedural framework. The decision relied on § 114 Abs. 1 Satz 1 ZPO in conjunction with § 76 Abs. 1 FamFG for the requirement of sufficient prospects of success, and § 70 FamFG in conjunction with § 5 Satz 1 and § 7 of the Lawyers' Fee Act (BerHG) to establish the unstatutory nature of the intended remedy.
