Dismissal of non-admission of revision complaint due to lack of fundamental significance and subsidiarity of procedural objection to evidence order
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiffs' complaint against the non-admission of their revision, thereby upholding the decision of the Oberlandesgericht Bamberg which denied leave to appeal; the plaintiffs were ordered to bear the costs of the proceedings. The dispute concerned a civil matter where the plaintiffs challenged the lower court's failure to order the submission of a power of attorney for a second tranche, alleging a violation of their right to be heard (*rechtliches Gehör*). The court held that the legal dispute lacked fundamental significance for the development of law or uniform jurisprudence, and the procedural objection was barred by the principle of subsidiarity, as the plaintiffs had not raised this specific objection in their response to the intermediate hint notice. The decision is based on § 543 Abs. 2 Satz 1 ZPO regarding the requirements for admitting a revision, § 142 ZPO concerning court orders for evidence submission, and § 544 Abs. 6 Satz 2 Halbsatz 2 ZPO permitting a concise reasoning for non-admission.
