Sentencing: Application of 1:3 credit ratio for foreign deportation detention in narcotics case
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Procedure (BGH) rejected the defendant's appeal as unfounded, leaving the lower court's conviction in force, but modified the sentencing order to mandate the credit of nine days of deportation detention incurred in Thailand against the imposed liberty sentence at a 1:3 ratio. The dispute concerned the sentencing calculation for a narcotics offense, specifically the method for converting foreign pre-trial detention into the domestic prison term to prevent the defendant from being disadvantaged by jurisdictional differences. Citing established case law on the necessity of determining specific conversion factors for foreign detention, the court applied a 1:3 scale (one day of Thai detention credited for three days of German imprisonment) as the decisive legal measure to ensure equitable treatment and exclude any potential benefit from the foreign detention conditions.

Strafbemessung bei Betäubungsmitteldelikt: Anrechung von Abschiebungshaft in Thailand
[TENOR]
November 2014 - 1 StR 299/14 Rn. 41; Beschluss vom 22. Dezember 2011 - 4 StR 514/11).
