Evidentiary motion admissibility: requirement of direct connection between proof claim and designated witness in criminal proceedings
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Justice (BGH) dismissed the defendant's appeal as unfounded, upholding the conviction from the Stendal Regional Court and ordering the defendant to bear the costs of the appeal and necessary expenses of the private prosecutor. The dispute centered on the lower court's rejection of a defense motion to hear a witness, which the defendant argued violated their right to evidence under § 244 Abs. 3 and 2 StPO; the factual context involved the defendant's alleged presence and conduct during a visit to a castle ruin with the private prosecutor. The BGH held that no reversible error occurred because the motion lacked the required "Konnexität" (logical connection) between the specific proof claim and the designated evidence, as the assertion that the witness was present at the ruin did not sufficiently establish that the witness had unobstructed visual observation of the defendant and the private prosecutor throughout the entire period, failing to meet the specificity requirements for a valid evidentiary motion rather than merely a suggestion.
