The Bundesgerichtshof dismissed the applicant's filing as inadmissible at the applicant's costs. The case involved a legal challenge filed in response to a prior senate decision, which the court interpreted as a request for a hearing under the German Code of Civil Procedure. The application was rejected because it was not submitted by a lawyer authorized to practice before the federal court, violating the mandatory representation rule applicable to all proceedings before the Bundesgerichtshof. The decision relies on § 321a Abs. 1 ZPO for the definition of the hearing request, § 78 Abs. 1 Satz 3 ZPO for the requirement of mandatory legal representation in federal court proceedings, and § 97 Abs. 1 ZPO for the allocation of costs.

Juli 2021 - I ZB 28/21, juris Rn. 2 mwN).

II. Die Kostenentscheidung beruht auf § 97 Abs. 1 ZPO analog.

III.
