Sexual offense conviction validity: sufficiency of witness credibility assessment without express "word-against-word" designation or null hypothesis framework
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Criminal Fourth Senate rejected the defendant's revision, upholding the Landgericht Bielefeld's guilty verdict from November 2023; the defendant was ordered to bear the costs of the appeal and the necessary expenses of the joint plaintiff. The dispute centered on a sexual offense where the defense argued the lower court erred by failing to address a "word-against-word" evidentiary scenario and by improperly evaluating witness credibility. The Court of Revision found no error in the factual assessment, confirming that the lower court had properly balanced all circumstances affecting the victim's reliability under Section 261 of the Code of Criminal Procedure (StPO). While the lower court did not expressly classify the evidence as "word-against-word," the appellate court determined this was not a legal defect, as the comprehensive weighing of evidence satisfied the requirements for a correct conviction. The decision also clarified that the "null hypothesis" method is applicable within the context of psycholinguistic expert assessments but is not a mandatory doctrinal framework for the general formation of judicial belief.

Juli 1999 ‒ 1 StR 618/98, BGHSt 45, 164, 168 f. i.V.m. Beschluss vom 30.
