The Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the lower court's decision and leaving the plaintiff to bear the costs of the proceedings. The dispute concerned a civil action where the plaintiff sought admission of revision, arguing issues regarding the guideline conformity of a policy model and the necessity of a preliminary ruling to the European Court of Justice. The court held that the question of EU law conformity was not decisive for the outcome and that a reference to the ECJ was unjustified because the relevant EU jurisprudence applied to cases involving consumers who had not been properly instructed, a scenario not present in the current case. The decisive legal basis was § 543 (2) Sentence 1 ZPO and § 544 (6) Sentence 2 ZPO, which established that the case lacked fundamental legal significance and did not require the development of law or the assurance of uniform case law.

Volltext

Februar 2023 - IV ZR 353/21, juris).

Der Kläger trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
