Sufficiency of factual evaluation in sexual assault convictions: independent corroboration rendering speculative dissenting witness logic immaterial
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the defendant's appeal against the guilty verdict issued by the Regional Court of Bremen, upholding the lower court's conviction and ordering the defendant to bear the costs of the appeal and the victim's necessary litigation expenses. The case involved a sexual assault allegation where the defendant challenged the sufficiency of evidence regarding the victim's testimony; specifically, the defense argued that the court's reasoning was flawed because it relied on the logical inconsistency of a severe physical bite occurring during penetration if the victim had consented. The BGH affirmed the conviction, holding that while the lower court's reference to this "expectation" argument was superfluous, it did not constitute a legal error because the court independently reached its finding of fact through a comprehensive and legally sound evaluation of the victim's credibility, corroborated by chat messages and testimony from a neutral witness, thereby meeting the standard for personal conviction of the judges.
