The Federal Court of Justice (BGH) partially admitted the plaintiff's appeal for admission of non-admission (Nichtzulassungsbeschwerde) against the Stuttgart Higher Regional Court's judgment, authorizing a third-instance review exclusively regarding the plaintiff's delictic damage claims and a specific declaratory relief concerning an amount exceeding €2,726.03, while dismissing the remainder of the complaint and waiving a written legal rationale pursuant to § 544 Abs. 6 Satz 2 Halbsatz 2 ZPO. The underlying civil dispute involved a plaintiff challenging an appellate decision that limited recovery of damages and the scope of a declaration of debt extinguishment, with the BGH determining that the identified issues met the threshold for higher-court review despite the general restriction on such appeals. The decisive procedural basis was the admissibility review under the German Code of Civil Procedure, specifically applying § 544 ZPO to evaluate whether the appellate court's reasoning on delictic liability and the calculation of the outstanding balance warrant a revision hearing.
