BGH non-admission of revision: no fundamental legal significance and no egregious procedural rights violation in partial decision against co-defendant during co-defendant's insolvency
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the defendant's complaint for non-admission of revision, upholding the lower court's refusal to allow an appeal to the supreme court and leaving the proceedings against the co-defendant interrupted. The dispute arose from civil litigation involving multiple defendants, where one party triggered an interruption of the proceedings due to the opening of insolvency proceedings, permitting a partial decision against the remaining simple co-defendant. The court ruled that the case lacked fundamental legal significance and did not require the development of law or the assurance of uniform jurisprudence to justify a revision under § 543 Abs. 2 ZPO, and it found the alleged violations of fundamental procedural rights to be non-egregious, thereby forgoing a detailed reasoning under § 544 Abs. 6 ZPO.
