Total Sentence Formation: Non-Consideration of Zäsurwirkung from Intermediate Judgment Deemed Non-Prejudicial to Defendant
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Justice dismissed the defendant's appeal, upholding the regional court's sentence and leaving the lower court's judgment in force. The case involved a challenge to the formation of a total sentence for multiple offenses, specifically concerning whether the intermediate court had correctly accounted for the "Zäsurwirkung" (severance effect) of a judgment rendered by a lower court between the commission of the first and subsequent offenses. The appellate court held that the defendant did not suffer prejudice from the omission of this legal principle; although the lower court failed to treat the first offense's sentence as separate due to the intervening judgment, the court definitively excluded the possibility that such a correction would have resulted in a lower overall punishment.

Berücksichtigung der Zäsurwirkung bei der nachträglichen Gesamtstrafenbildung
[TENOR]
