The Federal Court of Justice (6th Criminal Senate) rejected the defendant's appeal as unfounded, thereby upholding the Landgericht Neuruppin's December 4, 2023 conviction and order that the appellant bear the costs of the legal remedy. However, the court corrected the conviction clause to find the defendant guilty of distributing narcotics to minors and armed dealing with narcotics in concurrence with possession of a prohibited object, based on the grounds specified by the Federal Public Prosecutor. The decision addresses the proper characterization of the offenses committed, specifically clarifying that the acts constituted distribution to minors and armed dealing rather than the originally charged offenses, ensuring the legal qualification matches the material facts established at trial.
