Legislator-Zusammenfassung

The BGH 1st Civil Senate dismissed as inadmissible the applicant's "Anhörungsrüge" (complaint of being denied hearing) against the single judge's order of October 26, 2022, effectively upholding the lower court's procedural ruling. The dispute arose in a civil proceeding where the applicant failed to meet the mandatory pleading requirements to demonstrate that the single judge had disregarded decisive submissions of fact or law, thereby violating their right to be heard. The court held that because the specific deficiency required by statute was not substantiated, the complaint was inadmissible under § 69a Abs. 1 Nr. 2, Abs. 2 Satz 5, and Abs. 4 Satz 1 and 2 of the Court Fees Act (GKG), and explicitly rejected any alternative legal remedy not provided by law, ordering that no further response to additional submissions in this matter would be given.

Volltext

BGH, Beschluss vom 3. November 2021 - I ZB 28/21, juris Rn. 2; Beschluss vom 14. Dezember 2022 - I ZB 22/22, juris).
