The German Federal Court of Civil Procedure (BGH) dismissed as inadmissible the debtor's appeal (interpreted as a legal complaint) against the Regional Court Görlitz's March 25, 2024 order, with the debtor bearing the costs. The case involved a civil enforcement proceeding where the debtor challenged the lower court's decision. The court held that the appeal was inadmissible because it was not statutorily permitted for this type of ruling and had not been granted permission by the appellate court. The decision rests on §§ 574(1) Sentence 1 No. 1 and No. 2 ZPO, which limit the availability of legal complaints to statutory exceptions or express judicial permission, and notes that the refusal to grant such permission is not itself appealable.
