Unfair competition: Obligation to indicate quantity of individually heat-sealed chocolate spheres as "single packs" under EU Food Information Regulation
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-admission of its appeal on points of law, thereby upholding the lower court's ruling that the defendant engaged in unfair competition; the defendant bears the costs of the complaint proceedings. The dispute concerned the defendant's failure to label the number of individual units when repackaging chocolate spheres, with the core issue being whether the individually heat-sealed foil wrapping each sphere constituted a "single pack" requiring mandatory quantity indication under EU consumer information rules. The BGH held that the lower court's findings were free of legal error and that no questions of EU law interpretation required a preliminary ruling to the Court of Justice of the European Union, relying on Article IX No. 4 of Regulation (EU) No. 1169/2011 (Food Information Regulation) to establish that the individual foils met the definition of a single pack, thus triggering the labeling obligation.

Unlauterer Wettbewerb: Pflicht zur Angabe der Anzahl der Einzelpackungen bei der Umverpackung von Pralinenkugeln
[TENOR]
