The Federal Court of Justice (BGH) dismissed the defendant's complaint for lack of admission of appeal as inadmissible and imposed costs on the complainant, upholding the lower appellate court's refusal to admit the revision. The case involved a dispute worth approximately €60,800, where the defendant failed to file a reasoned complaint within the extended deadline set by the court president. Although the proceedings were suspended on November 1, 2023, due to the opening of insolvency proceedings, the court determined that because the appeal was already procedurally defective prior to this suspension, it could be rejected immediately without waiting for the suspension to end. The decision relied on a corresponding application of § 249 Abs. 3 ZPO, which permits the rejection of an already inadmissible legal remedy and the associated cost assessment during a period of suspension, alongside §§ 544 Abs. 4 and 97 Abs. 1 ZPO regarding the deadlines for filing reasoned complaints.
