Admission of revision on tort damages from vehicle marketing and waiver of justification under § 544(6)(2) ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Procedure (BGH) partially granted the plaintiff's non-admission complaint, admitting the appeal against the Oberlandesgericht Nürnberg's 2022 decision specifically regarding the dismissal of the plaintiff's tort liability claim for harm caused by the vehicle's being placed on the market, while rejecting the appeal concerning the waiver of interest on out-of-court legal costs and dispensing with a written justification under § 544(6)(2) ZPO. The dispute arises from a civil suit concerning tort damages (deliktische Schädigung) linked to the defect of a purchased vehicle, focusing on the manufacturer's or seller's liability for bringing the product into circulation. The key legal issue involves the admissibility of a revision appeal in a damages case under German civil procedure, intersecting with product liability principles and the specific procedural rule allowing the BGH to omit reasons in non-admission decisions where specific precedents on similar cost issues apply.
